Giuseppe “Joe” Giudice’s impending deportation after serving his federal prison sentence is wreaking havoc on his already troubled life.

The husband of Real Housewives of New Jersey convict, Teresa Giudice, claims prison officials are “improperly” preventing him from entering a prison-based alcohol-treatment program that could reduce his sentence up to a year. If he successfully completed the program — the reality fraudster would be eligible for house arrest on November 11, 2018.

According to court documents filed on Friday — Giudice’s attorney asserts that officials at Fort Dix Federal Prison in New Jersey are using a detainer placed on him by Immigration and Customs Enforcement (ICE), as a reason to prohibit him from the prison’s treatment program.

Inmates with a detainer are barred from participating in various programs, because the restriction prevents them from completing treatment as outlined.

Federal immigration laws dictate that after Joe completes his 41-month prison sentence, he’ll be deported back to his native Italy. 

As reported, Joe, 45, is a non-U.S. citizen. He was born in Italy and came to America as a little boy — therefore, the reality TV husband was always in imminent danger of being kicked out of the U.S., upon his release from prison.

In 2014, Joe and his reality star wife both pled guilty to bankruptcy fraud and submitting false loan applications to get $5 million in mortgages and construction loans. Giudice also pleaded guilty to tax evasion.

The habitual law-breaker also claims in the filing that the prison is preventing him from fighting his upcoming deportation. An immigration hearing is set for March 14, 2019 and the prison does not allow inmates to appear before immigration judges.

The dad of four has an extensive rap sheet — spanning over two decades:

  • Assault (Joe smashed a woman’s head into a mailbox in 1992)
  • Bank fraud
  • Bankruptcy fraud
  • Identity fraud
  • Tax evasion
  • Multiple DUIs
  • Driving on a suspended license (Joe’s had his driver’s license suspended more than a dozen times) 

Giudice is using the defense that other federal prisons allow inmates to challenge their deportations, so he should be able to as well. The court documents state:

“ICE’S placement of a detainer on him has deprived him of all programs afforded to other inmates at Ft. Dix without giving Mr. Giudice a chance to challenge his removability from the United States. He will not be able to fight removal until 2019.”

According to the Bureau of Prisons database, Joe’s release date is set for March 14, 2019. However, instead of going home, he’ll likely be turned over to the custody of Immigration and Customs Enforcement for his exile from the United States.
