Teresa Giudice Lawyer Writes Response Letter To Judge With More Request

As we reported yesterday, the primary reason for the split between Teresa Giudice and Wendy Feldman is due to Teresa’s new attorney, Stacy Ann Biancamano writing a request to the judge without Feldman’s knowledge or permission.

In the letter Teresa sent to the judge, she asserted her right to the “Second Chance Act,” which would allow her to serve 12 out of the 15 months in a halfway house.

In response to yesterday’s letter, the prosecutors quickly responded that the law doesn’t apply to convicted felons and asked the judge to deny the request.

Now today, Teresa’s new lawyer has responded to the prosecutors in a letter requesting Judge Salas consider Teresa’s a mother of four girls and valuable member of the community.

    My prediction for Teresa’s next trick is………she will acknowledge that Joe is not competent to care for the girls while she is away. Next we will hear that CPS has paid a visit to the home. If they remove the children….Joe and Teresa could be serving their sentences at the same time.

    The judge and the BOP have spoken. Teresa will be serving her time in Danbury Connecticut and the halfway house request was turned down.

            The judge said even if the halfway house option was brought up at sentencing, she would have said no. I hope this puts an end to all this crazy and she just goes away!

            As far as I know, she can not appeal. That was part of her agreement when she okayed the plea bargain. She agreed to the terms set forth in the plea deal. They were explained to verbally, (more than once I’m sure.), & she had to read them.

            I can’t imagine that this was not discussed with Teresa and her previous attorney. If it was discussed, I believe it would have gone in one ear and out the other.. “A half-way house? eeewwww” Could you see her turn her nose up at the thought of a half-way house back then? Today it looks great to her.

    She has the effrontery to challenge the Courts decisions? What insolence. What gall.. What audacity. I hope they enforce the full 15 months because Tre will not learn her lesson any other way.
    Where the ever lovin’ eff does this woman get off asking for special consideration from the courts time & time again?
    Because she is a mother? Where were her motherly instincts when she was putting fame, greed, money & all things name-brand before her 4 bee-u-ti-fool dawwtwers well being & welfare?

    Well then by that logic every other woman n a prison or Federal penitentiary, who has children under the age of 18, should appeal their convictions & request special compensation for being a mom.

    Not up until the day after her first family visit, when her girls walk out of that visiting room sobbing & brokenhearted because they now realize that their mother is imprisoned due to her own poor choices & bad decisions.
    Maybe then it will hit home & she will realize just how much damage she has inflicted on everyone & how much she needs to change!

    OY!!!! I just got off the phone with Michael, who is an attorney. He explained that this “Second Chance Act” applies mainly to the overcrowding of prisons. What the lawyer is trying to do is to have the judge reconsider her sentencing by using this law to their advantage. In other words, because the prisons are so overcrowded, she should be allowed to serve a portion of her time in a halfway house. Does she have the right to ask for this? Yes. Anyone has the right to appeal their sentence. Does Michael feel that the sentence will in fact be changed? No. First, she was given LESS than the minimum time, and second, Judge Salas was angered by the evidence brought in to court the day of the sentencing. He does not think that anything will come of this request. I asked if she could get more time….he laughed at me! Ah nuts! hehe Anyone who has been sentenced has the right to appeal, but that doesn’t mean that their appeal will be granted. Again, taking in to consideration the severity of the crimes committed, he highly doubts that any change in the sentence will occur. WHEW!!!!!

        • I know!! No sense at all. I don’t think it’s part of her appeal, just prison allocation recommendation from her new attorney. I’m sure she’s paying her attorney a bundle and the result will be the same.

            Okay. He said that this would not be an “appeal” per se. What they are asking for is that this law, “The Second Chance” law be applied to her sentence. They are asking for no change in the amount of time to be served, but rather WHERE it will be served.

        Thank goodness, right Chloe? I kept on asking him if he thought there would be any movement, and he kept on saying that he HIGHLY doubted that any change would be made taking in to consideration all of the facts that the judge had to consider when making her ruling.

    So it is being reported Teresa will be serving her sentence in Danbury, CT after all. It must be a “satellite” camp rather than the facility that transferred its women inmates and is being transitioned to house mostly men in the future.

        “The Federal Correctional Institution, Danbury (FCI Danbury) is a low-security United States federal prison for female inmates in Danbury, Connecticut. It is operated by the Federal Bureau of Prisons, a division of the United States Department of Justice. The facility also has an adjacent satellite prison camp that houses minimum-security female offenders. It was announced in the summer of 2013 that FCI Danbury would transition from housing women to housing men with the female inmates transferring out between August and December 2013 and the male inmates arriving in early 2014. The satellite camp will continue to house female offenders.[1]

        FCI Danbury is located in southwestern Connecticut, approximately 55 miles from New York City”

            It is my understanding that she will be housed in a minimum security facility. My friend’s sister is a correction officer at FCI Danbury. I don’t know her. She has alway believed that Teresa would “fare better” at Alderson Prison Camp but Danbury is closer to her home for visits.

            From what I found minimum is the easiest . so she has lucked out here and gotten what she asked for.

            I believe Alderson, WV (nicknamed “Camp Cupcake”) where Martha Stewart was sent and was talked about for Teresa too, is much like the Danbury camp where there is no fencing, etc.

          If you read down the thread, you will see that my son, who happens to be an attorney, explained that she does in fact have the right to do this. Do I think it should be granted? HELL NO!!!!! This woman deserves to be in prison, not a halfway house, and IMO, she’s damn lucky that she only got 15 months.

            I never said anything of the kind. IMO, she is already getting a lot less time than she deserved. She has the right to ask for the sentence be changed to more time spent in a halfway house. Should it be allowed? Not in my opinion. If that makes me “mean” in your eyes, I guess I’ll have to live with that.

        Exactly, even the judge knew that. She goes on these shows saying I didn’t know this I didn’t know that etc. etc. playing dumb. And when cornered she says I’m just thinking of my kids. I think if she came out and said what I did along with MY husband was wrong and I take full responsibility for it and apologize (which she never did not even Joe) to the people maybe even the prosecutor would have had a heart. But they knew that these people where con men all the way and didn’t care who got hurt.

          What has Tigerlily said that is vile or hateful? It’s all public record. Teresa has been given many opportunities to take responsibility and she has shown contrition only once and that was at sentencing when her butt was on the line. She had approximately three years to pay back some of the money she stole and she declined to pay a penny-deciding she’d rather buy designer handbags and clothes. She and her husband showed up at sentencing with fraudulent documents-hiding their assets from the court. I’m so sick of Teresa’s defenders saying that the people who are fed up with her must be “vile” or “hateful” people. You have no idea what kind of people we are. Stick to the facts and stop with the lame insults and grow up. This woman lives in the county next to me and she owes everyone-she never even paid the fertility clinic that helped with the conception of her youngest daughter. That’s disgusting.

        No West. It is NOT the closest. Once again Teresa is only thinking of herself. It is at least a 3 or 4 hour drive from NJ to CT.
        Manhattan & Brooklyn are about an hour from home & you can take mass transit so Juicy doesn’t have to drive.
