Tonight All About The Tea is hosting a Q&A session on this thread with the brilliant attorney, Stacy Slotnick, Esq aka The Foxy Jurist at 8 p.m EST.

Tonight on the “Real Housewives of New Jersey,” we’ll see Teresa Giudice’s legal drama unfold as she heads to court and pleads guilty. Teresa and her husband Joe make a legal decision that will decide their fate and change their lives forever. As news spreads about a possible plea deal in Teresa’s court case, Dina and Melissa plan a surprise getaway to cheer their friend up in her most desperate time. Meanwhile, Amber and Nicole’s fragile reconciliation takes an unwanted detour when Amber starts texting Nicole’s boyfriend Bobby.

    I’m looking forward to Stacy’s comments on the plea deal. I’d like to know more about the fines and payment plans the judge called for. Also just how many years of income tax records she wanted resubmitted.

    I appreciate SOOOOO much when Stacy joins our little gathering to answer questions. Nice to get FACTS and wade through the supposition and rumors.

    One elementary thing I’d like to know is why has Juicy not been held accountable for the obvious when he fraudulently acquired that driver’s license? Seems clear to me it was for more than just driving that he needed the fake ID. Sometimes, though, ‘obvious’ things to me are factually skewed through my often short circuit hard drive brain.

      Is it true that after his sentencing in July nay September nay October nay who knows when that the reality TV star will be back in court to face charges that he presented false identification in an attempt to get a driver’s license when his was suspended? I cannot believe that case is still circulating in the courts. I suppose the federal fraud case gets priority. But next time he should stick to breaking one law at a time so that the court isn’t filled with State v. Giuseppe Giudice cases. (Giudice is accused of trying to get a license while his was suspended because of a drunk driving incident, the report said. If convicted, he faces up to 10 years in prison on those charges alone.)

        His lawyer did mention the state case some months ago and, if I remember his remarks correctly, he indicated that once the Fed case was done, a plea would be entered in the state case.

    I’m far from an expert, but what we will be seeing tonight happened quite a long time ago. If you recall, they showed this on the first night of RHONJ, and then flashed back 4 months. We are finally at the point where they are shown pleading guilty. Since that time however, I’m sure that there have been many behind the scenes changes going on between lawyers, prosecutors, and the guilty parties. We will be seeing what happened initially, but it remains to be seen what the outcome will be. I strongly hope that justice will ultimately be served.

    • Hi Nan….I agree, a lot of time has gone by since that fateful day on March 4th. And a whole lot of behind the scenes legal maneuvering have taken place. The most recent delay seems indicative of that. I’m still sticking with 2 months prison for Tre and 4 years for Joe.

        I think you might be right Doc, but what a travesty of justice that would be. They both deserve so much more time in prison. Stealing almost 14 MILLION dollars and getting 4 years and 2 months? Anyone else wouldn’t see the light of day for at least a decade. It pays to be a criminal and be on a Bravo show! Geesh….. :-/

          nan, I’ve also seen some lawyers who, like Nancy Grace, insist that the Feds simply hate liars and are very unforgiving when it comes to perjury. That’s why I think she’ll get prison time. But I think it will be less than a year behind bars.

Do you honestly think that if it were “John Smith” who committed these identical crimes he would get so little time? NO WAY! I’m sorry WCF. This makes me so angry….No offence intended.

            I’ll take the less than a year for her, if it includes a like amount of time under house arrest. I figure he’s going to get another 4 from the state and then be deported, so I’m happy with that.

            I shudder to provide sentencing predictions because its like reading tea leaves. No matter how many bench and jury trials I’ve tried, it is very difficult to read jurors and judges. I think they should both probably serve time in prison based on what they have admitted to and the sentencing guidelines.

      Great point. The interest with tonight’s episode has everything to do with whether they show Teresa and Joe consulting their lawyers and how much of the blame they truly take. If people are transparent and sincere, their transgressions (maybe even big ones can be forgiven much faster.

        Stacy, how can you diminish what they did just because they sincerely take the blame for their crimes? Of course they will say anything to get less time, but does that make them any less culpable?

          You be well this week. Please do not apologize for these questions. It’s my pleasure. As for reconciling engaging in criminal behavior and being sorrowful, the U.S. has a justice system that does forgive, hence probation and sentence limits for certain types of crimes. It’s incredibly difficult for judges and juries to figure out during the guilt and sentencing phase of trials who is remorseful but we have to make judgment calls that aren’t always black and white. Here, I do believe there are no shades of grey. They are only sorry because they got caught.

          Yoh Nan,
          My take on lies and truth is certainly not novel but….
          I’ve found that a person who lies regularly thinks that everybody else lies regularly. I’ve also found that a person who tells the truth equally feels that everybody else tells the truth.
          The kicker is that the “truther” gets real hurt when they have to realize that the one lying to them is doing just that. The flip side kicker is that the “liar” just thinks it’s no big deal until it’s somebody they have really relied upon who lets them down and then they are totally crushed.
          I don’t think that Teresa wears all that honest a coat. But, I also think that she’s pretty much a nimrod, so what would anybody expect.

    I will TRY to watch tonight, but can’t stand Teresa’s whining “Why is this happening to me?” “I want my old life back” etc is infuriating. Afraid I’ll break the TV by throwing something at it.

    O/T filled my new car for the first time. Felt like it was a baby taking first step or getting first tooth. I live in a small, somewhat rural town, so the clerks in the store very supportive of the event. 🙂

Information overload. LOL. Kind of fun to do the brain aerobics learning new stuff that’s not imperative for staying alive. Easier doing it on my own speed anyway.

    I agree with nan/4. This all happened long ago. IMO, if everything was signed sealed delivered for the plea, there’d be no hold up in the sentencing. That’s how I see it anyway. Glad to have Stacy to clear this up. Something’s up.

      I believe that most delays in the criminal justice system favor the defendant(s). There are behind-the-scenes happenings in which both Joe and Teresa’s lawyers are vying for favor with the court by showing that their client is a decent member of society and a reformed criminal.

        I am wondering if there is a possibility that the postponement of the Giudice’s sentencing for a week may have something to do with the Feds or defense lawyers going to the judge with clips of Teresa’s continual whine in her talking head scenes of “Why is this happening to us”.

        When Teresa went to court in March to plead guilty, the judge would have asked Teresa if she understood the charges against her and if she
        understood that by pleading guilty to the charges she would be giving up her right to a jury trial where she could explain to the world how she is “good people” and is not guilty of any of the charges. It would have been explained to her that upon entering a guilty plea her fate would then rest in the hands of the judge and the Federal sentencing guidelines. If the judge did her job properly, she would have explained this to Teresa, in great detail, approaching the issues from different angles,to ensure that Teresa really did understand what was going on.

        So maybe those talking head scenes have alerted the prosecution or the defense that Teresa, on national television, has repeatedly made statesments about her believing she has done nothing wrong and doesn’t understand why this is happening to her. It raises the question did she plead guilty erroneously because being dumb as a box of rocks she didn’t grasp the concept of what a guilty plea meant. After all, we don’t want to send an innocent person to jail just because the only thing she is guilty of is being stupid.

          This is such an excellent point. Anyone accepting a plea has to allocute, right? They have to formerly admit wrong doing in open court and the judge has to accept that allocution as truthful.

          However, as you so correctly point out this woman has repeatedly said she has done nothing wrong. She obviously can’t be convicted of a crime for statements made on reality TV and in social media, but I think the “Two Teresas” are going to hard time convincing the judge she’s being honest in any way shape or form. It just gets more and more frustrating.

        “Joe admitted to forging former business partner Joe Mastropole’s signature. When told that that admission would cost him $260,000, Joe told his lawyer, “So in other words, never tell the truth.”
        “After Joe admitted to forging mortgage documents in 2007, Teresa said, “I don’t feel my husband did anything wrong, to tell the truth. But I guess the judge did what he had to do.”

          Excellent quote. Excellent. Also remember the field day festivities they had. Gia became quite irate that someone might be cheating. Teresa said in a talking head interview, possibly filmed months later, that “Gia was so upset because they teach them that cheating is wrong in school.” Teresa then shrugs her shoulders, blinks her dolls eyes, and considers home schooling her children. Old schooling her children that is.

    Stacy, will the court documents be available for public reading or will they be sealed after sentencing?

      If there was a deposition or trial, the record would be public. The prosecutor will likely give a statement as to SOME of the terms of the settlement but not all. The judge in her sentencing ruling may also disclose the terms of the agreement. The beauty of the type of settlements that I deal with when I represent celebrities is that they are all sealed. We will not know who or what the Giudices gave up that allowed them to plead to lesser included offenses unless they disclose it.

Her attorney will have to show that their four children rely on them for caretaking or financial support. They will have to lay out what the scenario is if they are both sent to prison, meaning what their children’s caretaking and financial predicament would be. They’d have to paint a pretty bleak picture of what life for the Giudice kids looks like without Joe and Teresa.

    I’m far from an expert, but what we will be seeing tonight happened quite a long time ago. If you recall, they showed this on the first night of RHONJ, and then flashed back 4 months. We are finally at the point where they are shown pleading guilty. Since that time however, I’m sure that there have been many behind the scenes changes going on between lawyers, prosecutors, and the guilty parties. We will be seeing what happened initially, but it remains to be seen what the outcome will be. I strongly hope that justice will ultimately be served. I’m looking forward to hearing Stacy’s take on what might be happening now, and what she thinks will be the final outcome of this big fat mess!!!!

      • Maybe i didn’t say it right….Apollo scored a plea deal that allows him to enter federal rehab program to knock off 2 years because a zillion years ago he got a dwi, whereas, juicy really has a alcohol issue and some RUMOR a pill issue and maybe a dabble in coke? + his dwi is still current issue – kinda—so, f Apollo can score the 2 years deduct + Juicy attorney should be able to present those options UNLESS he forgot to ask during plea deal. Judge has to agree t it at sentence.

            I think this is such a key point. Though it absolutely infuriates me that Teresa is constantly referring to her family and her love and concern for her “little girls” …. I think in this case any judge would have to consider the kids. This is a case where both parents are going to college pretty much at the same time, not just a father or a mother, but both. Plus there’s four kids here, not one or two, will they get split up? It’s so horrific.

            If Joe and Tre want to act like animals and criminals, it happens, it’s always left up to taxpayers and customers that pay their bills to clean up the mess, but for them to commit these crimes and then play the sympathy card as loving parents makes me want to vomit.

            The definition of Chutzpah? You’ve heard the joke? A child is convicted of murdering his parents and then throws himself on the mercy of the court on the grounds that he’s an orphan. Case in point.

While we still struggle some, it is unbelievable how much progress he has made and I hope that Nick does just as well. He is mainstreamed most of the day now and never stops talking.     From Teresa, I’ve never heard a single word of concern for the people who provided goods and services in good faith to these CONVICTED CRIMINALS. The providers still have to pay their suppliers and so on. It’s a domino effect. She refers to the economic crash as though it’s a separate entity. I know Teresa’s pea brain refuses to understand that SHE is the economy. We all are.

    I want to see Teresa do lock up time. Sleeping on bedding that’s had on it every bodily fluid known at one time or another. Toilets and showers with no walls. Air freshener is non existent. People who’d rather cut you for sport than to look at you. At least 30 days in those skeevy conditions.

    Teresa’s Sept 29 case has been postponed, but not to despair. My insatiable appetite for following criminal stuff will be fulfilled, because I think Jodi Arias’ sentencing trial begins in Phoenix on the 29th. Refresher: JA has already been found guilty, but in AZ they then have a separate trial for the penalty phase. The first jury could not agree on the death penalty or life in prison. Interesting and I’ll watch because I don’t quite understand that process of how they will bring a new jury up to speed with no new evidence presented. All this jury can decide is the penalty.

    FWIW, I am 100% AGAINST judicially mandated death penalty andbelieve it should be removed as an option EVER.

JA is acting as her own attorney and has been granted no cameras in the courtroom. The press is trying to get delayed broadcast rights. Should be interesting how the new jury is brought up to speed. 1st degree guilty verdict isn’t in dispute, so new evidence cannot be presented. AZ’s process is different and weirdly fascinating.

      This will be a huge challenge for the prosecutor to deliver an expedited summary of the case. They will have to select the most gruesome photos and connect the dots rather speedily. I gather it will take the prosecutor 4 weeks to lay out their case in chief for the new jury. The challenge for the penalty phase jury is to accept everything the guilt phase jury found as gospel. Trial lawyers revisit their cases frequently, building upon what they did well and what they would have done differently. Prepare to see both sides offering very compelling arguments for and against the death penalty.

          I watched closely the Jodi Arias trial so I am all aboard, Harley Girl! It’s fascinating that she told Judge Sherry Stephens that she objects to new motions that would permit limited TV coverage of the retrial. She loves the cameras as evidenced by the gruesome photos she took of Travis Alexander. The judge has ruled out live video coverage for the sentencing phase. Her objecting to limited coverage is a tactic that gives her more exposure, no question. She’ll fight it tooth and nail and then probably acquiesce when all is said and done. I know there have been motions back and forth between Arias and her attorneys. They want to quit and she wants to fire them. The judge did approve her motion to represent herself and appointed Nurmi and his second-chair attorney, Jennifer Willmott, as her legal advisers.

          I’m sure everything with their name on it will be auctioned off sooner than later. She said she was driving around getting #’s for houses cause she’d not afraid of downsizing and she’s not materialistic! I wonder how that’s all gonna work out for her?     Stacey, this question is late but I’ve been thinking about this all night. If , god forbid, you were Tre’s lawyer would you allow her to express remorse or take ownership for any wrong doing during filming done pre-sentencing?

      This is a very good question. Teresa must show remorse to the judge when she goes before her. She has already admitted to wrongdoing in the plea deal so now she is begging the court to show mercy when it comes to sentencing. Conversely, if a defendant is convicted, the sentencing phase can be tricky because you want to preserve on appeal any issues you possibly can. If your client, the defendant, shows remorse, you are pretty much sunk on appeal because remorse is the same thing as admitting guilt. If your client maintains their innocence, he or she might get a tougher sentence because he or she failed to show remorse for a crime he or she was convicted of but you have preserved your case for appellate purposes. Teresa has to show sorrow and regret. There is no question of guilt. When there is a question of guilt, that’s when a lawyer has a tougher job deciding whether to have their client continue to plead his or her innocence during the penalty phase.

          Hi Jenny! I agree with you but no matter how her and her atty’s spin it she is gonna look stupid! She wants us to believe she is a smart business woman, yet she didn’t read papers she was signing? Or she tells us what a rock solid relationship her & Joe have yet she is totally blind to the finances and again didn’t read what she is signing? Or did she read & sign legit papers and then Joe took them and fudged them, cause that’s what all amazing loving husband do? None of those scenarios make her look good. So frustrating!

    I had so much fun last night! The addition of Stacy to our family here was a brilliant idea. I learned so much about this case from her legal expertise. Thanks Stacy! Add to that the banter between all of us, and it’s ALL GOOD!! Thank-you so much for making my night one that was filled with so much laughter and insight. AAtT truly is a very unique site…a mixture of a good amount of snark with equal parts of sincere caring for one another. That’s a winning recipe in my book!

        Hey there Harley! OMG! We have so much to talk about. I know exactly where you are outside of Philly! We sure do have a lot in common. I hope you liked the video of the Bacon Brothers. They did that in 2010 because the Mummers had no money to continue with their parades! So ALL of the proceeds went to the Mummers, and they sold tee shirts too! They still are selling them, so I bought two. I have to help my Mummers! 😉

        Anyway, I’m off to the doctor today…OY! I have no idea what is in store, so if I don’t get back to you soon, take good care Harley. I’ll miss you!!!!

      I kind of have to agree with you. I was waiting to hear more from the attorneys and see an actual back and forth of “do we or don’t we admit to the charges?” I mean, it is reality TV after all. One thing I tell my clients who are in the spotlight is that they should know their audience. For instance, I might have a client who is booked to talk about the NFL concussion lawsuit settlement on ESPN. That client of mine will understand that sports is just as important as the law when he or she is booked on ESPN. Teresa and Joe know they have to show some of their thought process regarding these charges, and they never did. Let’s just say Ramona Singer may have been demoted on RHONY because she refused to play the game and answer Andy’s questions on this year’s reunion show. Just saying.

      I swear to you my house looked just like that from the first snowfall til what felt like June! We had so much freaking snow and ice. If I called my friends and said come help me shovel they would have said eff you!!!!! LOL That’s why we have sons and their friends to shovel for us!         I had my first at 40 and have had one every year since! OMG this will be my 10th….yikes! I’ve had my own scare and have been through double mastectomy with my friend 5yrs ago. She now has beautiful perky teenage looking boobs while everyday I have to pick mine up off my belly and position them in my bra…LOL !!!! Oh and she has never once played the cancer card!!!!
